Privacy Policy

Deskrex, Inc. (hereinafter referred to as the “Company”) hereby establishes this Privacy Policy (hereinafter referred to as this “Policy”) regarding the handling of user information, including personal information, in the service provided by the Company (hereinafter referred to as the “Service”).

Article 1 (User Information Collected and Collection Methods)

In this Policy, “user information” means information related to the identification of users, behavioral history on communication services, and other information generated or accumulated in connection with users or users’ devices, which is collected by the Company based on this Policy. The user information collected by the Company in the Service includes the following, depending on the collection method.

1. Information Provided by Users

The following information may be provided by users in order to use the Service or through the use of the Service:
  • Name, address, postal code, email address, date of birth, gender, occupation, social media account information, and other profile-related information
  • Transaction-related information
  • Transaction details and purchase history, etc.
  • Payment-related information
  • Financial institution account information, payment and payment method information, etc.
  • Information obtained in connection with the use of the Service
  • Cookie IDs and other online identifiers, device information, location information, browsing history, and other information on Service usage (including access logs, IP addresses, browser information, browser language settings, etc.)
  • Information related to inquiries and communications from customers to the Company
  • Information entered or transmitted by users through input forms or other methods specified by the Company
  • Other information

2. Information Provided by Other Services Through User-Authorized Integration

When users authorize integration with other services such as social networking services in order to use the Service, the following information may be collected from such external services based on the content consented to at the time of authorization:
  • IDs used by users on such external services
  • Other information that users have allowed to be disclosed to the integration partner through the privacy settings of such external services

3. Information Collected by the Company in Connection with Users’ Use of the Service

The Company may collect information about the access status and usage methods of the Service. This includes the following information:
  • Device information
  • Referrer
  • IP address
  • Server access log information
  • Cookies, ADID, IDFA, and other identifiers
When users individually consent through the method specified in Article 3, Paragraph 1, the Company may collect the following information from the device in use:
  1. Location information
  2. Various surveys and questionnaires

Article 2 (Purposes of Use)

The specific purposes of use of user information related to the provision of the Service are as follows:
  1. To provide the Company’s services
  2. For registration acceptance, identity verification, user authentication, recording of user settings, calculation of usage fees, and other purposes related to the provision, maintenance, protection, and improvement of the Service
  3. For measuring user traffic and behavior
  4. To provide information customized for each user by analyzing user attributes, action information, log information, etc.
  5. For distribution, display, and effectiveness measurement of advertisements
  6. For guidance regarding the Service and responding to inquiries
  7. For guidance on seminars, events, etc., and survey research
  8. To send emails introducing other services provided by the Company
  9. To display user information on the Service (including third-party media, platforms, etc. that are linked to the Service via application programming interfaces (APIs) or other methods)
  10. To respond to actions that violate the Company’s terms, policies, etc. (hereinafter referred to as “Terms, etc.”) regarding the Service
  11. For other purposes of use consented to by users

Article 3 (Methods of Notification, Publication, or Consent Acquisition, and Methods of Requesting Cessation of Use)

  1. User consent shall be obtained before collecting the following user information:
    1. Location information
    2. Various surveys and questionnaires
  2. Users may request the cessation of collection or use of all or part of their user information by performing the prescribed settings and applications for the Service, in which case the Company shall promptly cease such use in accordance with the Company’s prescribed procedures. Note that for some items of user information, collection or use is a prerequisite for the Service, so the Company shall only cease collection or use when the user withdraws from the Service through the Company’s prescribed method.

Article 4 (External Transmission, Third-Party Provision, and Information Collection Modules)

  1. In the Service, the following partner may store Cookies on users’ devices and use them to accumulate and use user information.
  2. The Company may use third-party services such as application programming interfaces (APIs) to maintain and improve the Service. For example, queries may be sent to external AI services such as the OpenAI API to process requests. Personally identifiable information is not transmitted except when necessary for the continuation of the Service, such as sending emails, processing payments, and providing customer support.
  3. The Company does not use user information or User-Generated Content for training AI or machine learning models provided by the Company or third parties. The Company also applies opt-out settings to ensure that user data is not used for model training by external AI services used by the Service. The Company may use anonymized statistical information for internal analysis for the purpose of improving the Service.

Article 5 (Security Measures)

The Company establishes a management system for the protection of personal information in accordance with business practices regarding the handling of personal information, and takes reasonable preventive measures to protect acquired personal data. The Company exercises the utmost care when handling personal information for business purposes and ensures that only persons granted the authority necessary for business purposes have access to such information.

Article 6 (Third-Party Provision)

The Company shall not provide personal information among user information to third parties (including those located outside Japan) without obtaining the prior consent of the user. However, this shall not apply in the following cases where provision to third parties (including those located outside Japan) is necessary:
  1. When the Company outsources all or part of the handling of personal information to the extent necessary to achieve the purposes of use
  2. When personal information is provided due to business succession through merger or other reasons
  3. When posting data including user information on third-party media, platforms, etc. linked to the Service for the purposes described in Article 2, Paragraph 6
  4. When the Company determines that there are sufficient grounds to justify disclosing user information in order to protect the Company’s rights, property, or services when the user violates the Terms of Service
  5. When necessary for the protection of life, body, or property of a person, and it is difficult to obtain the consent of the individual
  6. When particularly necessary for the improvement of public health or the promotion of healthy development of children, and it is difficult to obtain the consent of the individual
  7. When personal information is provided to partners or information collection module providers in accordance with Article 4, Paragraph 1
  8. When all or part of the handling of user information is outsourced to an external company based on a business outsourcing agreement (including cases where the management and analysis of information is outsourced to a business outsourcing contractor for the purpose of storing on servers and improving the quality of the Service). In such cases, the Company shall appropriately supervise the outsourcing contractor by concluding agreements regarding the handling of user information and ensuring that the security of user information is maintained at the outsourcing contractor.
  9. When it is necessary to cooperate with a national agency, local government, or a person entrusted thereby in the execution of duties prescribed by laws and regulations, and obtaining the consent of the user may hinder the execution of such duties
  10. In other cases permitted by the Act on the Protection of Personal Information (hereinafter referred to as the “Personal Information Protection Act”) or other laws and regulations
  11. When providing user information for the Company’s advertisement distribution and effectiveness analysis
    • The Company may provide user information to advertising distribution companies and other businesses (hereinafter referred to as “advertising partner businesses”) to distribute advertisements related to the Service and other Company services and to analyze their effectiveness. The types of information disclosed in such cases are as described below. Information collected by advertising partner businesses is not provided or disclosed to the Company and is managed and used in accordance with the privacy policies established by the advertising partner businesses.
    • Advertisements distributed by advertising partner businesses may include behavioral targeting advertisements that use behavioral history collected by such advertising partner businesses on sites other than the Service. If you wish to disable such behavioral targeting advertisements by our partners, please access the opt-out page of each business listed in the “List of Advertising Partner Businesses” below and follow the procedures.
    • The types of information disclosed are device information, log information, advertising identifiers (AAID, IDFA), and user attribute information as defined in Article 1, Paragraph 3.
  12. When providing the following information to advertisers or their outsourcing contractors for the purposes described in Article 2, Paragraph 4
    • The types of information disclosed are the fact that the user has accessed an advertisement page displayed on the Service and the user’s advertising identifier (AAID, IDFA).
When the Company outsources payment functions to an external provider, the privacy policy of such external provider shall apply to the handling of credit card information.

Article 7 (Incident Response)

In the event of a data breach or other incident involving personal data, the Company shall promptly notify the Personal Information Protection Commission and the affected individuals in accordance with the Personal Information Protection Act, and shall publicly disclose the facts and measures to prevent recurrence.

Article 8 (Joint Use)

The Company shall jointly use users’ personal information as follows:
  1. Items of personal information to be jointly used
  2. Scope of parties who jointly use the information
  3. Purposes of use by parties who jointly use the information
  4. Name or title of the person responsible for the management of personal information

Article 9 (Disclosure of Personal Information)

When requested by a user to disclose personal information based on the provisions of the Personal Information Protection Act, the Company shall disclose such information to the user without delay after confirming that the request is from the user (if such personal information does not exist, the Company shall notify the user accordingly). However, this shall not apply when the Company is not obligated to disclose under the Personal Information Protection Act or other laws. Please note that a fee (1,000 yen per request) is charged for the disclosure of personal information.

Article 10 (Correction and Suspension of Use of Personal Information)

  1. When the Company receives a request from a user for (1) correction of the content of personal information based on the provisions of the Personal Information Protection Act on the grounds that the personal information is not true, or (2) suspension of use based on the provisions of the Personal Information Protection Act on the grounds that it has been handled beyond the scope of the previously published purposes of use or has been collected through deception or other improper means, the Company shall, after confirming that the request is from the user, promptly conduct the necessary investigation and, based on the results, correct the content or suspend the use of the personal information and notify the user accordingly. If the Company decides not to make corrections or suspend use, it shall notify the user accordingly.
  2. When the Company receives a request from a user to delete the user’s personal information, and the Company determines that it is necessary to comply with such request, the Company shall, after confirming that the request is from the user, delete the personal information and notify the user accordingly.
  3. When the Company is not obligated to make corrections or suspend use under the Personal Information Protection Act or other laws, the provisions of Article 8, Paragraph 1 and Article 8, Paragraph 2 shall not apply.

Article 12 (Improvements and Changes to the Privacy Policy)

The Company shall modify this Policy for continuous improvement and as necessary. However, for changes to this Policy that require user consent under applicable laws, the revised Policy shall apply only to users who have consented to the changes through the Company’s prescribed method. When the Company changes this Policy, the Company shall publicize the effective date and content of the revised Policy by displaying it on the Company’s website or through other appropriate methods, or notify users.

The following are the main advertising partner businesses or services that the Company may use. Some of the advertisements displayed on the Service or on sites other than the Service may be behavioral targeting advertisements by these businesses.
